The College uses Dispute Resolution (DR) to facilitate the resolution of suitable complaints regarding members of the profession. DR is voluntary and without prejudice to the parties. The results of the DR process are similar to those that would be expected following a full investigation and hearing.

The members in the cases reported here have consented to the publication of a summary of the complaint and its resolution.

Following notification by a school board, the Registrar initiated a complaint against a member of the College alleging that the member had received and retained on his employer's computer system personal e-mail that included pictures of a pornographic and/or graphic nature.

On April 16, 2004, the Investigation Committee ratified a memorandum of agreement (MOA) between the member and the College, in which the member

  • acknowledged the allegations
  • agreed to be cautioned by the Investigation Committee, in writing, regarding his actions
  • agreed to complete a course of instruction regarding the appropriate use of the Internet and e-mail
  • agreed to provide the Registrar with written confirmation of completion of the course of instruction
  • agreed not to use any school board computers for non-teaching related purposes
  • agreed that the College would provide the employer with a copy of the Investigation Committee's written decision and of the MOA.

The College received a complaint from a member of the public against a member of the College alleging that the member had used inappropriate physical disciplinary measures with a male high school student in that the teacher had grabbed the student by the sweatshirt and shoved him.

On April 30, 2004, the Investigation Committee ratified an MOA between the complainant, the member and the College, in which

  • the parties acknowledged that the member had retired from the teaching profession
  • the member agreed to be cautioned by the Investigation Committee, in writing, regarding his actions
  • the member agreed to provide the complainant with a letter acknowledging the events giving rise to the complaint and expressing his sincere regret for those actions
  • the member agreed that the College would provide the employer with a copy of the Investigation Committee's written decision and of the MOA.

Following notification by a school board, the Registrar initiated a complaint against a member of the College alleging that he had engaged in conduct that raised boundary issues. The conduct included allowing students to spend time alone in his office, driving students home, eating lunch with students off school property and making inappropriate comments to students such as, "Wow, you look good today." When concerns were brought to the school board's attention, it conducted an investigation and placed a letter of reprimand in the member's personnel file.

On May 28, 2004, the Investigation Committee ratified an MOA between the member and the College, in which the member

  • acknowledged the allegations
  • agreed to be cautioned by the Investigation Committee, in writing, regarding his actions
  • agreed to complete a course of instruction regarding maintaining appropriate boundaries with students
  • agreed to provide the Registrar with written confirmation of completion of the course of instruction
  • agreed to provide the Registrar with a copy of his next Teacher Performance Appraisal
  • agreed that the College would provide the employer with a copy of the Investigation Committee's written decision and of the MOA.

Following notification by a school board, the Registrar initiated a complaint against a member of the College alleging that he had engaged in unprofessional conduct, calling students names such as "big jerk" and exercising poor judgement when dealing with misbehaving students, including preventing a student from walking away by holding his knapsack.

On May 28, 2004, the Investigation Committee ratified an MOA between the member and the College, in which the member agreed

  • to be cautioned by the Investigation Committee, in writing, regarding his actions
  • to complete a course of instruction regarding positive classroom management strategies
  • to provide the Registrar with written confirmation of completion of the course of instruction
  • that the College would provide the employer with a copy of the Investigation Committee's written decision and of the MOA.

Following notification by a school board, the Registrar initiated a complaint against a member of the College alleging that he had engaged in inappropriate conduct including grabbing a male secondary school student by the lapels of his vest and tapping him on the face with his hand.

On May 28, 2004, the Investigation Committee ratified an MOA between the member and the College, in which

n the parties acknowledged that the member had engaged in counselling with respect to the issues raised in the Registrar's complaint and had provided the Registrar with written confirmation of the counselling

  • the member admitted that he engaged in the alleged conduct

Following notification by a school board, the Registrar initiated a complaint against a member of the College alleging that he had used profanity in the presence of students.

On September 24, 2004, the Investigation Committee ratified an MOA between the member and the College, in which the member

  • admitted that he engaged in the alleged conduct
  • agreed to be cautioned by the Investigation Committee, in writing, regarding his actions
  • agreed to successfully complete a course of instruction regarding positive classroom management strategies and to provide the Registrar with written confirmation of completion
  • agreed that the College would provide the employer with a copy of the Investigation Committee's written decision and of the MOA.

Following notification by a school board, the Registrar initiated a complaint against a member of the College alleging that he had engaged in conduct raising boundary issues, which included taking a photograph of a female student while she was wearing a bathing suit and sending her e-mail.

On October 29, 2004, the Investigation Committee ratified an MOA between the member and the College, in which the member

  • admitted that he engaged in the alleged conduct
  • agreed to be cautioned by the Investigation Committee, in writing, regarding his actions
  • agreed to successfully complete a course of instruction regarding maintaining appropriate boundaries with students and to provide the Registrar with written confirmation of completion
  • agreed that the College would provide the employer with a copy of the Investigation Committee's written decision and of the MOA.

Following notification by a school board, the Registrar initiated a complaint against a member of the College alleging that he had engaged in inappropriate interactions with a female secondary school student, including sending her e-mail of a personal nature, offering her and other students an opportunity to travel abroad with the soccer team and offering to help her and other students gain employment.

On November 26, 2004, the Investigation Committee ratified an MOA between the member and the College, in which the member

  • admitted that he engaged in the alleged conduct
  • agreed to be cautioned by the Investigation Committee, in writing, regarding his actions
  • agreed to successfully complete a course of instruction regarding maintaining appropriate boundaries with students and to provide the Registrar with written confirmation of completion
  • agreed that the College would provide the employer with a copy of the Investigation Committee's written decision and of the MOA.

Following notification by a school board, the Registrar initiated a complaint against a member of the College alleging that he had engaged in conduct raising boundary issues which included touching the leg of a sweatpant-clad female student, patting two female students on the back, and placing his hand on a female student while controlling traffic in the hallway during recess.

On November 26, 2004, the Investigation Committee ratified an MOA between the member and the College, in which

  • the parties acknowledged that the member had resigned from his position at the school board
  • the member admitted that he engaged in the alleged conduct
  • the member agreed to be cautioned by the Investigation Committee, in writing, regarding his actions
  • the member agreed not to seek or engage in employment where Certificates of Qualification and Registration are required, with the exception of a teaching position involving adult students only
  • the member agreed that if he should he gain a position teaching adult students, he shall
    • successfully complete a course of instruction regarding maintaining appropriate boundaries with students
    • provide the Registrar with written confirmation of completion
  • the member agreed to a notation on the public register regarding the limitation allowing him to teach adult students only
  • the member agreed that the College would notify those education authorities regularly notified of the member's limitation allowing him to teach adult students only
  • the member agreed that a copy of the Investigation Committee's written decision, including the MOA, shall be kept in the College's Margaret Wilson Library
  • the member agreed that the College would provide the employer with a copy of the Investigation Committee's written decision and of the MOA.

Following notification by a school board, the Registrar initiated a complaint against a member of the College alleging that while experiencing difficulty controlling the behaviour of students in his class, he raised his voice and yelled. The Registrar also alleged that the member rushed through the class and bumped the chair of a student causing her stomach to collide with her desk.

On December 17, 2004, the Investigation Committee ratified an MOA between the member and the College, in which the member

  • admitted that he engaged in the alleged conduct
  • agreed to be cautioned by the Investigation Committee, in writing, regarding his actions
  • agreed that should he return to employment where Certificates of Qualification and Registration are required he shall
    • successfully complete a course of instruction regarding positive classroom management strategies
    • provide the Registrar with written confirmation of completion
  • agreed that the College would provide the employer with a copy of the Investigation Committee's written decision and of the MOA.

Following publication of a newspaper article, the Registrar initiated a complaint against a member of the College alleging that he had engaged in unprofessional conduct, which included roughhousing or wrestling with male students, building kitchen cabinets for parents of students, providing students with employment opportunities and meeting with a student off school property.

On January 27, 2005, the Investigation Committee ratified an MOA between the member and the College, in which the member

  • admitted that he engaged in the alleged conduct
  • agreed to be cautioned by the Investigation Committee, in writing, regarding his actions
  • agreed to provide the Registrar with a written report from the principal of his current school indicating whether additional complaints of a similar nature have been brought to the attention of the school or school board
  • agreed that the College would provide the employer with a copy of the Investigation Committee's written decision and of the MOA.

Following notification by a school board, the Registrar initiated a complaint against a member of the College alleging that she had grabbed the hall pass of a male student who was wearing the pass around his neck.

On February 25, 2005, the Investigation Committee ratified an MOA between the member and the College, in which the member

  • admitted that she engaged in the alleged conduct
  • agreed to be cautioned by the Investigation Committee, in writing, regarding her actions
  • agreed to successfully complete a course of instruction regarding positive classroom management strategies and to provide the Registrar with written confirmation of completion
  • agreed that the College would provide the employer with a copy of the Investigation Committee's written decision and of the MOA.

When the Discipline Committee finds a member guilty of professional misconduct, the member's name is routinely published in Professionally Speaking. If a similar matter is disposed of by the Investigation Committee or DR at the investigation stage, and the result is a caution, the name of the member is not published. The College monitors compliance with all agreements reached through DR.
